   en un próximo nivel— para justificarlos. Habermas afirma que “la ponderación se
   ejecuta arbitraria o irreflexivamente según estándares y jerarquías consuetudinarios”;30
   pero las suposiciones que subyacen a los juicios sobre grados de intensidad no son
   arbitrarias.
   El Tribunal Constitucional Federal trata como grave la intervención en la libertad
   de expresión, porque la condena a indemnizar podría perjudicar la futura disposición
   de los demandados a producir su revista de la manera en que hasta entonces lo habían
   hecho; éste es un argumento, y no uno malo. Es muy discutido si el señalamiento de
   “asesino nato” representa en efecto un menoscabo leve o medio, pero sólo es difícil
   negar que el tribunal alegara razones para su clasificación, que al menos vale la pena
   considerar.
   El tribunal fundó finalmente su punto de vista en que señalar a un parapléjico
   como “inválido” es un perjuicio grave a su personalidad, y de esta manera que ello es
   humillante y despreciable; en primer lugar esto es un argumento, y en segundo uno
   bueno. Por eso no puede decirse que la ponderación tuviera lugar “arbitrariam
